These Terms of Service (“Terms”) govern your access to and use of eChatbot’s websites, applications, and related services (the “Service”). By creating an account or using the Service, you agree to these Terms.
eChatbot provides tools to create, configure, and embed AI chatbots that answer questions using your uploaded or connected knowledge sources (RAG). Features may include document upload, URL crawl, chat preview, public embed widgets, workspaces, analytics, and related functionality described in the product.
You must be able to form a binding contract and meet any minimum age required in your jurisdiction. You are responsible for your account credentials and for activity under your account. Provide accurate registration information and keep it updated.
The Service offers a Free plan with soft quotas (for example limits on chatbots, documents, or public chats). Quotas and available features may change. Exceeding limits may temporarily block certain actions until usage resets or you adjust usage. AI provider usage is separate from Free plan quotas (see BYOK below).
You may supply API keys for third-party AI providers. You authorize us to use those keys solely to perform Service features you request (such as embeddings and chat completions). You are solely responsible for:
We encrypt stored keys and do not claim ownership of your provider accounts. Rotating platform encryption secrets or deleting keys may require you to re-enter keys.
You retain ownership of documents, prompts, chatbot configurations, and other content you submit (“Customer Content”). You grant us a limited license to host, process, transmit, and display Customer Content only as needed to provide and secure the Service. You represent that you have the rights necessary to submit Customer Content and that it does not violate law or third-party rights.

We may suspend or terminate access for violations or risk to the Service or other users.
If you embed the widget on a website, you are responsible for that site’s compliance with law (including notices to end users) and for configuring allowed domains appropriately. End-user chats may be stored in your workspace according to product settings.
The Service, including software, branding, and documentation (excluding Customer Content), is owned by eChatbot and its licensors. These Terms do not grant you rights to our trademarks except as needed to truthfully refer to the Service.
The Service may integrate with third-party products (AI providers, hosting, email, payments, analytics). Your use of those products is subject to their terms. We are not responsible for third-party services we do not control.
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. AI-GENERATED OUTPUTS MAY BE INACCURATE OR INCOMPLETE; YOU MUST REVIEW OUTPUTS BEFORE RELYING ON THEM.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, eChatbot AND ITS AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR GOODWILL. OUR AGGREGATE LIABILITY FOR CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) AMOUNTS YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM OR (B) FIFTY US DOLLARS (US$50) IF YOU USE ONLY THE FREE PLAN.
You will defend and indemnify eChatbot against claims arising from your Customer Content, your use of the Service, your embeds on third-party sites, or your violation of these Terms or applicable law.
You may stop using the Service and request account deletion subject to product tools and residual retention. We may suspend or terminate the Service or your access with notice when reasonable, or immediately for serious risk or breach. Provisions that by nature should survive will survive termination.
We may modify the Service or these Terms. We will post updated Terms and change the “Last updated” date. If you continue using the Service after changes take effect, you accept the updated Terms where permitted by law. If you do not agree, stop using the Service.
These Terms are governed by the laws of Vietnam, without regard to conflict-of-law rules, unless mandatory consumer protections in your country require otherwise. Courts in Vietnam will have jurisdiction over disputes, subject to applicable mandatory law.
